Sample Stealin’ Blue Minis Puppy Contract
When you purchase a puppy from me, you are agreeing to my contract whether you sign it or not.
The following contract has been read fully and willingly entered into by the seller: Stealin’ Blue Minis, and the Buyer:_________________________________.
This agreement has been entered into on / / 2023. The total price of the puppy/dog is _______________. Before eyes open - prices range from $995 to $1995, excluding blue-eyed Black Tris or blue-eyed Red Tris--price ranges from $1495-$1895. A deposit of $________________ was placed on said puppy/dog on the date of / /2023, leaving a balance of $_________________, which must be paid in full before the puppy/dog is shipped to, or is picked up by, the buyer.

A. To the best of my knowledge, said puppy/dog is in healthy and sound condition at the time of sale. Buyer has 2 business days from the time of delivery/pickup to have a vet check done on puppy. Vet check must be done by a licensed veterinarian. Buyer is required to have a licensed veterinarian administer three more puppy vaccines to said puppy. Parvo and Distemper vaccines must be given at three four-week intervals following first vaccines given by breeder. If buyer fails to have vet check done within 2 business days or fails to continue vaccines as stated above, the parties agree that any guarantee will be considered null and void. Vet records must accompany any claim on behalf of the buyer.
B. All puppies/dogs, including this one, are sold as pet quality only. Puppy is warrantied only for the purpose of being a companion animal. While the animal may be capable of performing other functions, no warranty is given as to its fitness for any special purpose. Buyer agrees to notify breeder of any health or temperament problems that develop in this puppy/dog during its life. (i.e. cancer, heart problems, joint problems, etc.)
Breeder strongly encourages buyer to attend puppy obedience classes with puppy to help provide proper socialization. Breeder requires owner to spay/neuter the puppy at or near 6 months of age as recommended by a veterinarian.
If at any time the buyer is unable to keep said puppy, please contact seller. We will be happy to help you place your dog in a good home or will take him/her back into our home. No refund of money or replacement puppy will be offered under these circumstances. At no time should you take your puppy/dog to a shelter/pound! We guarantee we WILL always take our puppies back at any time.
We offer no guarantee on the eye color, weight, or height of your puppy as these traits are unpredictable and can change during the growth process. Although our dogs come from generations of proven miniatures/toys, crop outs are still possible.
Our dogs are sold as pets, breeding rights are sold to approved homes only.
C. Health guarantee does not cover any parasite, internal or external as this is a treatable condition. The said puppy has been vaccinated and dewormed. A record/schedule will be provided.
D. This puppy is a purebred Miniature or Toy Australian Shepherd.
E. A deposit in the amount of $200 is required to hold the puppy of your choice. Deposits are non-refundable. Deposits are applied to the purchase price of your puppy. Deposits on a puppy ensure it is reserved for you and means it is no longer available for sale because it is saved for you. The outstanding balance shall be paid in cash, money order, or cashier’s check before the purchaser obtains possession of the puppy. Other forms of payment must be approved by seller.
The deposit signifies intent on the behalf of the purchaser to follow through with the purchase transaction of the puppy.
If the buyer changes his/or her mind the deposit is forfeited and NO refund will be given. Please be certain you want to reserve a puppy because deposits are non-refundable.
If the seller chooses to void the contract for any reason the deposit will be refunded in full to the buyer.
If some tragic accident occurs and the puppy should die before it goes home with the buyer we will offer a refund to the buyer, unless the buyer wants to apply the deposit to another available puppy, or the deposit can be held for a future puppy of the buyer's choice.
If the color or sex of the puppy is not produced in the mentioned litter the buyer shall be offered another puppy from the same litter. If the buyer chooses not to purchase a puppy from the said litter (see above description of litter) the deposit will be applied to another available puppy/litter.
Any money placed on a puppy is non-refundable and non-transferable unless agreed to by seller.
It has been mutually agreed by both the seller and the buyer that the puppy will be held until 8 weeks old unless other arrangements have been made in writing and shown below.
This contract is an agreement that the buyer will spay or neuter puppy at approximately 7 months of age as recommended by a veterinarian, or purchase breeding rights. Registration papers will be held by Stealin’ Blue Minis until proof of spay or neuter by licensed veterinarian is presented to Stealin’ Blue Minis. This contract is binding and transfers to any and all future owners of this puppy. Breeding rights are sold to approved homes only, are nontransferable and must be purchased from Stealin’ Blue Minis by any or all future owners of this dog.
Seller is in no way responsible for any vet bills made after puppy/dog leaves the care of Stealin’ Blue Minis. In the event that a problem should arise with said puppy, buyer should contact their veterinarian immediately.
****Included when you receive your puppy are proof of current worming/vaccinations, parents’ MDR1 records, along with a ‘Developmental Stages’ guide, Puppy Exercise/Activity Guide, recommended vacc schedule, NuVet vitamins, dried liver treats, puppy’s dry and canned food, Fortaflora probiotic supplement, puppy scented blanket and three “puppy approved” play toys.****
Shipping is always the responsibility of the buyer, even in the event a puppy is to be sent back and/or replaced. Any and all vet bills are the responsibility of the buyer. NO exceptions. Please note: Any puppy that has not been picked up or shipped by 9 weeks is subject to a boarding fee unless otherwise discussed. After this age, all expenses incurred for the purchased puppy are the responsibility of the buyer.
All shipping costs related to any dog being purchased, as well as in relationship to any dog being replaced for any reason, are the responsibility of the buyer. Seller shall not be responsible for death of said puppy/dog due to negligence or carelessness of any airline or other live animal carrier, its agents or employees, or the buyer.
WE RESERVE THE RIGHT TO SELL ANY PUPPY WE CHOOSE TO ANYONE WE CHOOSE OR DENY SALE TO ANYONE FOR ANY REASON, AND WE RESERVE THE RIGHT OF FIRST PICK FROM ANY LITTER.
This contract is under the jurisdiction of the state of Colorado. In the event of any dispute, the parties mutually agree that the dispute will be settled under the jurisdiction of Montezuma County, Colorado.
All parties mutually agree that all lawyer fees shall be paid by the buyer.
In the event that a court of law finds any part of this agreement unenforceable, all remaining provisions not deemed unenforceable will be enforced to the full extent of the law.
This agreement sets forth the entire agreement between parties. This agreement may not be changed, altered or amended except in a written amendment signed and agreed upon by both parties.
Stealin Blue Minis
SPAY/ NEUTER AGREEMENT
Permanent ownership of this dog is contingent upon your compliance with this Addendum. The breeder must receive proof of the spay/neuter procedure having been performed no later than the female becoming 6 months and the male becoming 9 months. Proof of the spay/neuter is required and must be received by Stealin Blue Minis within fourteen (14) days after the surgery. In the event that the dog’s health does not allow this agreement to be honored, Stealin Blue Minis must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog the PURCHASER will contact the veterinarian and establish the earliest date that the procedure can be performed. PURCHASER will notify Stealin Blue Minis of this amendment in writing, at which time all other conditions of this agreement will apply and be enforced.
This is the responsibility of the PURCHASER, not the veterinarian, to ensure that Stealin Blue Minis has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract, and the PURCHASER will be liable for $2500.00 or will transport this dog back to Stealin Blue Minis and will not be entitled to a refund.
By my signature below, I agree to have this dog spayed/neutered by no later than six months of age for a female and 9 months of age for a male dog. I understand that this spay/neuter agreement is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. I also agree that should the puppy not be altered I will agree to pay the additional cost of $2500.00 for a breeding dog or return said puppy back to Stealin Blue Minis with no refund.
